How do I find out if there are any easements, covenants or other interests on the property?

Easements, covenants and other legal interests are recorded on a property’s Certificate of Title, which is held by Landgate.

The Shire does not maintain records of easements or title interests.

How do I find out the zoning of a property?

To confirm the zoning of a property, type the property address into the WAPC Plan WA mapping portal: PlanWA Select ‘See Land Enquiry Report’ in the left and column. Under ‘Local Planning Scheme (LPS)’, the local zoning for the property will be available.

What is the difference between a development approval and a building permit?

· Development (planning) approval relates to how land is used and whether a proposal complies with zoning and planning policies.

· Building permits relate to construction standards, structural safety, and compliance with building regulations.

Both approvals may be required depending on the proposal.

Can I meet with the Shire to confirm if a property is compliant before buying?

The Shire does not provide pre-purchase inspections or certify private property compliance.

The Shire is unable to provide financial or legal advice on buying or selling property. Prospective buyers should undertake independent due diligence, including a Certificate of Title, Property Interest Report and advice from a settlement agent or qualified professional before entering into a contract.

What is a Property Interest Report?

A Property Interest Report (PIR) is a report available from Landgate that provides information about known interests which may affect the use and enjoyment of a property. A PIR complements a Certificate of Title but does not replace it. Prospective purchasers may wish to obtain both a Certificate of Title and a Property Interest Report as part of their due diligence before entering into a contract to purchase land.
